1. The user is obliged to ensure the safety of payment instruments (in particular, FTE) and individual accounting information in secret beyond the access of third parties.
2. Within the limits of measures aimed at preventing non-execution or improper execution of payment transactions, LLC “SIMPLEPAY”:
• regularly checks, diagnoses, tests software and hardware, server and network facilities in operation and, if necessary, corrects/corrects them;
• regularly checks its activities in the provision of financial payment services for compliance with current legal requirements and compliance with the rules of payment systems;
• builds software and hardware infrastructure in such a way that it meets the requirements of reliability, round-the-clock operation and ensures continuous provision of services;
• in order to ensure compliance with the Payment Card Industry Data Security Standard (PCI DSS) and other requirements of payment systems, it may engage other legal entities, including technology operators, to process the relevant data;
• ensures protection and electronic storage of user data and data on their payment transactions for 5 (five) years from the date they were carried out and provided users with access to them;
• ensures (and in the case of involving third-party companies, controls, verifies and ensures that such third-party companies provide) the security and protection of user data (including FTE data of users) at the level provided for by the procedures/rules of the payment system and international security standards PCI DSS;
• has the right to apply restrictions on the possibility of carrying out payment transactions with certain parameters (from a certain payer/FTE of the payer, to a certain recipient/FTE of the recipient, for a certain amount, for a certain period of time, etc.), and in the case of applying such restrictions – has the right to refuse the user to carry out a payment transaction;
• exchanges information with other participants in the payment infrastructure, providers of payment services, in order to clarify information about users and their payment transactions, as well as increase reliability and continuity in the provision of services;
3. LLC “SIMPLEPAY” is liable in the event of non-fulfillment or improper execution of payment transactions:
• obligation to return funds to the payer for an unfulfilled payment transaction;
• obligation to compensate the user for damages incurred as a result of non-execution or improper execution of a payment transaction;
• bears other responsibilities stipulated by the contract.
4. The procedure for interaction between LLC “SIMPLEPAY” and the user in case of fraud (suspicion of fraud) or a threat to the security of a payment transaction corresponds to the general procedure for interaction with a consumer of financial services (see section “Procedure for considering requests from consumers of financial services”), taking into account the following:
• the user’s request in case of fraud or security threat is considered by employees of LLC “SIMPLEPAY” who have the appropriate profession, competence and experience;
• a user’s request in the event of fraud or a security threat is considered first, and the results of the review and the user’s decisions are reported immediately;
• if it is necessary to notify the user about a case of fraud or security threat, the user is notified immediately, and any available communication method is used to transmit the message;
• in the event of incidents involving the use of FTE, LLC “SIMPLEPAY” provides the user with information on the procedure for resolving a dispute, the procedure for conducting a dispute or arbitration in accordance with the rules of the payment system whose FTE was used, and provides consultations on other issues at the user’s request;
• LLC “SIMPLEPAY”makes every effort to ensure interaction with users in case of fraud or security threats 24 hours a day, 7 days a week.
5. The procedure for interaction between LLC “SIMPLEPAY” and the user in the event of unaccepted, erroneous, improper payment transactions and the procedure for the user to apply for compensation for damage caused as a result of payment transactions corresponds to the general procedure for interaction with the consumer of financial services (see section ” The procedure for considering appeals from consumers of financial services”), taking into account the following:
• the user’s request in case of unaccepted/false/improper payment transactions is considered by employees of LLC “SIMPLEPAY” who have the appropriate profession, competence and experience;
• the user’s request in case of unaccepted/false/inappropriate payment transactions is considered first, and the results of the review and the user’s decisions are reported immediately;
• if it is necessary for the user to report a case of unaccepted/false/improper payment transactions, the user is notified immediately, and any available communication method is used to transmit the message;
• LLC “SIMPLEPAY” conducts an internal investigation into each unaccepted/false/inappropriate payment transaction and, based on the results of such investigation, provides information in the appropriate amount to the user or other participant in the payment transaction;
• LLC “SIMPLEPAY”makes every possible effort to ensure interaction with users in case of unaccepted/false/inappropriate payment transactions 24 hours a day, 7 days a week;
6. The user’s request for compensation for damage caused as a result of unaccepted/false/improper payment transactions, as well as as a result of non-execution/improper execution of a payment transaction, is carried out in the following order:
• the user submits an appeal in the general manner, citing the circumstances of the loss;
• LLC “SIMPLEPAY” considers the appeal and: in case of detection of possible guilt on the part of participants in the payment transaction other than LLC “SIMPLEPAY”, it recommends that the user initiate an appropriate review according to the rules of the payment system or submit an application to their servicing bank/bank – the issuer; or in case of discovery of guilt on the part of LLC “SIMPLEPAY” – performs the following steps;
• LLC “SIMPLEPAY” identifies the user to the extent necessary to establish the user’s affiliation with the payment transaction;
• the user provides a written statement of compensation for damages, drawn up in any form and signed in the usual way or using the EPC if the application is submitted electronically;
• LLC “SIMPLEPAY” provides compensation in the manner and within the time limits in accordance with the requirements of the law and internal documents.
